Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and AlignAgain Inc. ("Align Again," "we," "us," or "our") governing your use of the Align Again website, mobile applications, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Align Again is an emotional wellness and mood tracking platform. The Service lets you log your emotions and their intensity, write reflections, complete wellness questionnaires, and receive AI-assisted insights and suggestions based on what you share. The Service is a self-reflection tool intended to support your personal wellbeing practice.

2. Not Medical Advice

Align Again is not a medical device, does not provide therapy, counseling, diagnosis, or treatment, and is not a substitute for professional mental health or medical care. Content provided through the Service — including AI-generated reflections and suggestions — is for informational and self-reflection purposes only. Always seek the advice of a qualified health professional with any questions you may have regarding a medical or mental health condition. Never disregard or delay seeking professional advice because of something you read in the Service. If you are in crisis or thinking about harming yourself or others, do not use the Service — contact emergency services or a crisis line immediately. See our Health Disclaimer for crisis resources.

3. Eligibility and Accounts

  • You must be at least 16 years old to use the Service.
  • You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
  • You agree to provide accurate information when creating your account and to keep it up to date.
  • You may delete your account at any time from your profile settings; see our Privacy Policy for how your data is handled.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the Service, other users' accounts, or our systems.
  • Interfere with or disrupt the Service, including by introducing malware, scraping at scale, or circumventing rate limits or security measures.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Impersonate any person or misrepresent your affiliation with anyone.
  • Use the Service to harass, abuse, or harm others, or to upload content that is unlawful, defamatory, or infringing.
  • Resell, sublicense, or commercially exploit the Service without our written consent.

5. Subscriptions and Payment

The Service is currently offered free of charge. Certain features of the Service may in the future be offered under paid subscription plans. Pricing, billing cycles, renewal, cancellation, and refund terms will be described at the point of purchase and incorporated into these Terms when paid plans launch. While the Service is offered free of charge, this section does not apply.

6. Your Content

You retain ownership of the content you submit to the Service, including mood logs, notes, and questionnaire responses ("User Content"). You grant us a limited, non-exclusive license to host, store, process, and display your User Content solely to operate and improve the Service for you, including processing by our AI service providers as described in our Privacy Policy.

7. Intellectual Property

The Service — including its software, design, text, graphics, logos, and the EmotionBubble and related visual elements — is owned by AlignAgain Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited right to use the Service for personal, non-commercial purposes, no rights are granted to you under these Terms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR CIRCUMSTANCES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AlignAgain Inc. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your use poses a risk to us, the Service, or other users. Sections that by their nature should survive termination (including Sections 6–9 and 11) will survive.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any disputes arising out of or relating to these Terms or the Service will be resolved in the courts of the State of Delaware, United States, unless applicable law requires otherwise.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
